These terms and conditions apply to the EveryPanda app (hereby referred to as "Application") for mobile devices, created by EveryPanda, Inc. (hereby referred to as "Service Provider") as a Freemium service.
By downloading or using the Application, you automatically agree to the following terms. We strongly advise that you read and understand these terms before using the Application. Unauthorized copying or modification of the Application, any part of it, or our trademarks is strictly prohibited. Attempts to extract the source code, translate the Application into other languages, or create derivative versions are not permitted. All trademarks, copyrights, database rights, and other intellectual property rights related to the Application remain the property of the Service Provider.
Subject to your compliance with these Terms, the Service Provider grants you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the Application solely for your personal, non-commercial use.
You agree not to misuse the Application or assist anyone else in doing so. Prohibited conduct includes but is not limited to modifying, copying, reverse engineering, hacking, attempting to gain unauthorized access, or using the Application in violation of any applicable laws or third-party rights.
The Service Provider is committed to ensuring the Application is as beneficial and efficient as possible. As such, they reserve the right to modify the Application or charge for services at any time and for any reason. Any charges for the Application or its services will be clearly communicated to you.
To the fullest extent permitted by law, the Service Provider shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, profits, or use, arising out of or related to your use of the Application.
The Application stores and processes personal data you have provided in order to deliver the Service. It is your responsibility to maintain the security of your device and access to the Application. The Service Provider strongly advises against jailbreaking or rooting your phone, as this removes software restrictions imposed by your device's official operating system. Such actions could expose your device to malware, viruses, or malicious programs, compromise security features, and may cause the Application to malfunction or stop working entirely.
Please be aware that the Service Provider does not assume responsibility for certain aspects. Some functions of the Application require an active internet connection via Wi-Fi or mobile network. The Service Provider cannot be held responsible if the Application does not function at full capacity due to lack of Wi-Fi access or exhausted data allowance.
If you use the Application outside of a Wi-Fi area, your mobile network provider's agreement terms still apply. You may incur charges from your provider for data usage during connection to the Application, including roaming charges if you use the Application outside your home territory without disabling data roaming. By using the Application, you accept responsibility for any such charges. If you are not the bill payer for the device, it is assumed you have obtained permission from the bill payer.
Similarly, the Service Provider cannot always assume responsibility for your usage of the Application. It is your responsibility to ensure your device remains charged. If your device runs out of battery and you cannot access the Service, the Service Provider cannot be held responsible.
While the Service Provider strives to keep the Application updated and accurate, they rely on third parties to provide certain information. The Service Provider accepts no liability for any loss, direct or indirect, that you experience as a result of relying entirely on any functionality of the Application.
The Service Provider may update the Application at any point. System requirements may change, and you will need to download updates to continue using the Application. The Service Provider does not guarantee the Application will always be updated to remain relevant or compatible with your particular operating system version. However, you agree to accept updates when offered. The Service Provider may also cease providing the Application and terminate its use at any time without notice.
